I. General Terms and Con\u00addi\u00adtions<\/strong><\/p>\n

\u00a7 1 Basic Pro\u00advi\u00adsions<\/strong><\/p>\n

(1) The fol\u00adlowing terms and con\u00addi\u00adtions apply to con\u00adtracts (ser\u00advices and products\/goods) that you con\u00adclude with us as the pro\u00advider (City\u00adGames GmbH | Adam Hellmann) via the website spritztour.de. Unless otherwise agreed, the inclusion of any of your own terms and con\u00addi\u00adtions is hereby rejected. <\/p>\n

(2) A con\u00adsumer within the meaning of the fol\u00adlowing pro\u00advi\u00adsions is any natural person who con\u00adcludes a legal tran\u00adsaction for pur\u00adposes that are pre\u00addo\u00admi\u00adnantly neither attri\u00adbu\u00adtable to their com\u00admercial nor their self-employed pro\u00adfes\u00adsional activity. An entre\u00adpreneur is any natural or legal person or a legal part\u00adnership with legal capacity who, when con\u00adcluding a legal tran\u00adsaction, acts in the exercise of their inde\u00adpendent pro\u00adfes\u00adsional or com\u00admercial activity. <\/p>\n

Section 2 For\u00admation of the Con\u00adtract<\/strong><\/p>\n

(1) The subject of the con\u00adtract is the sale of ser\u00advices and products\/goods.<\/p>\n

(2) By listing the respective service\/product on our website, we already make a binding offer to con\u00adclude a con\u00adtract under the con\u00addi\u00adtions spe\u00adcified in the item description.<\/p>\n

(3) The con\u00adtract is con\u00adcluded via the online shopping cart system as follows: The services\/goods intended for purchase are placed in the \u201cshopping cart.\u201d You can access the \u201cshopping cart\u201d at any time via the cor\u00adre\u00adsponding button in the navi\u00adgation bar and make changes there. After accessing the \u201ccheckout\u201d page and entering per\u00adsonal data as well as payment and shipping con\u00addi\u00adtions, all order details are dis\u00adplayed again on the order overview page. If you choose an instant payment system (e.g. PayPal) as the payment method, you will first be directed to the order overview page in our online shop or then redi\u00adrected to the website of the pro\u00advider of the instant payment system to confirm the purchase there. Finally, you will be redi\u00adrected back to our online shop to the order overview page.
\nBy sub\u00admitting the order via the \u201corder with obli\u00adgation to pay\u201d button, you declare legally binding accep\u00adtance of the offer, whereby the con\u00adtract is con\u00adcluded. <\/p>\n

(4) Your request for the pre\u00adpa\u00adration of an offer is non-binding. We will provide you with a binding offer in text form (e.g. by email), which you can accept within the spe\u00adcified period. <\/p>\n

(5) The pro\u00adcessing of the order and the trans\u00admission of all infor\u00admation required in con\u00adnection with the con\u00adclusion of the con\u00adtract are carried out by email, partly in an auto\u00admated manner. You must the\u00adr\u00adefore ensure that the email address you have pro\u00advided to us is correct, that receipt of emails is tech\u00adni\u00adcally ensured, and in par\u00adti\u00adcular that it is not pre\u00advented by spam filters. <\/p>\n

(6) Rebooking and can\u00adcel\u00adlation:<\/p>\n

(6.1) Rebooking of \u201cLive im Lokal\u201d tickets and live tastings to another pre\u00adferred date: a flat pro\u00adcessing fee of \u20ac25 applies.<\/p>\n

(6.2) Can\u00adcel\u00adlation of \u201cLive im Lokal\u201d tickets and vou\u00adchers: exclusion of with\u00addrawal and return rights.<\/p>\n

(6.3) Can\u00adcel\u00adlation of beer web\u00adinars and live tastings: exclusion of with\u00addrawal and return rights.<\/p>\n

(6.4) Con\u00addi\u00adtions for indi\u00advi\u00addually cus\u00adto\u00admized tastings:<\/p>\n

(6.4.1) Changes to boo\u00adkings \/ adding indi\u00advidual par\u00adti\u00adci\u00adpants as well as extras\/specials: changes to boo\u00adkings are free of charge up to 14 days before the event; from 14 days before the event and for each addi\u00adtional change, a flat pro\u00adcessing fee of \u20ac15 applies; can\u00adcel\u00adlation of indi\u00advidual par\u00adti\u00adci\u00adpants is only pos\u00adsible up to 24 hours before the event; com\u00adplete rebooking of the tasting to another pre\u00adferred date costs a flat fee of \u20ac50; all changes must be made by email.<\/p>\n

(6.4.2) Can\u00adcel\u00adlation of the booking: must be made by email; up to 4 weeks before the event, a can\u00adcel\u00adlation fee of \u20ac100 applies; from 4 weeks before the event, a can\u00adcel\u00adlation fee of 50% of the total invoice amount applies; from 48 hours before the event, a can\u00adcel\u00adlation fee of 75% of the total invoice amount applies.<\/p>\n

(7) Can\u00adcel\u00adla\u00adtions and changes on our part: Occa\u00adsio\u00adnally, it may be necessary for us to correct certain details, errors, or changes. In this context, it may happen that we need to cancel or amend already con\u00adfirmed tickets. We reserve the right to do so in such cases. <\/p>\n

Section 3 Right of Retention, Retention of Title<\/strong><\/p>\n

(1) You may only exercise a right of retention insofar as it con\u00adcerns claims arising from the same con\u00adtractual rela\u00adti\u00adonship.<\/p>\n

(2) The goods remain our pro\u00adperty until full payment of the purchase price has been made.<\/p>\n

\u00a7 4 War\u00adranty and Gua\u00adrantees<\/strong><\/p>\n

(1) The sta\u00adtutory lia\u00adbility for defects applies.<\/p>\n

(2) In the case of the purchase of used goods by con\u00adsumers, the fol\u00adlowing applies: if a defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year from delivery of the goods may be asserted within the sta\u00adtutory limi\u00adtation period of two years from delivery of the goods. For entre\u00adpre\u00adneurs, the limi\u00adtation period for defect claims for newly manu\u00adfac\u00adtured goods is one year from the transfer of risk. The sale of used goods is carried out under exclusion of any war\u00adranty. The sta\u00adtutory limi\u00adtation periods for recourse claims under Section 445a of the German Civil Code (BGB) remain unaf\u00adfected.
With respect to entre\u00adpre\u00adneurs, only our own state\u00adments and the manufacturer\u2019s product descrip\u00adtions that have been incor\u00adpo\u00adrated into the con\u00adtract shall be deemed agreed as the quality of the goods; we assume no lia\u00adbility for public state\u00adments made by the manu\u00adfac\u00adturer or other adver\u00adtising claims. If the deli\u00advered item is defective, we shall provide war\u00adranty to entre\u00adpre\u00adneurs at our dis\u00adcretion either by reme\u00addying the defect (repair) or by deli\u00advering a defect-free item (repla\u00adcement delivery).
The above limi\u00adta\u00adtions and reduc\u00adtions of limi\u00adtation periods do not apply to claims for damages caused by us, our legal repre\u00adsen\u00adta\u00adtives, or agents:
In the event of injury to life, body, or health.
In the event of inten\u00adtional or grossly negligent breach of duty, as well as frau\u00addulent intent.
In the event of breach of essential con\u00adtractual obli\u00adga\u00adtions, the ful\u00adfillment of which is necessary for the proper exe\u00adcution of the con\u00adtract and on whose com\u00adpliance the con\u00adtractual partner may regu\u00adlarly rely (car\u00addinal obli\u00adga\u00adtions).
Within the scope of a gua\u00adrantee, if agreed.
Insofar as the scope of appli\u00adcation of the Product Lia\u00adbility Act is opened.
Infor\u00admation on any addi\u00adtional gua\u00adrantees that may apply and their exact con\u00addi\u00adtions can be found with the respective product and on spe\u00adcific infor\u00admation pages in the online shop. <\/p>\n

(3) As a con\u00adsumer, you are requested to check the goods imme\u00addiately upon delivery for com\u00adple\u00adteness, obvious defects, and transport damage, and to notify us and the carrier of any com\u00adplaints as quickly as pos\u00adsible. Failure to do so shall have no effect on your sta\u00adtutory war\u00adranty claims. <\/p>\n

\u00a7 5 Choice of Law, Place of Per\u00adfor\u00admance, Juris\u00addiction<\/strong><\/p>\n

(1) German law shall apply. In the case of con\u00adsumers, this choice of law shall apply only insofar as it does not deprive the con\u00adsumer of the pro\u00adtection afforded by man\u00addatory pro\u00advi\u00adsions of the law of the country of their habitual resi\u00addence (prin\u00adciple of favora\u00adbility). <\/p>\n

(2) The place of per\u00adfor\u00admance for all ser\u00advices arising from the business rela\u00adti\u00adonships with us, as well as the place of juris\u00addiction, is our regis\u00adtered office, pro\u00advided that you are not a con\u00adsumer but a mer\u00adchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general place of juris\u00addiction in Germany or the EU, or if your place of resi\u00addence or habitual resi\u00addence is unknown at the time the action is filed. The right to also bring pro\u00adcee\u00addings before a court at another sta\u00adtutory place of juris\u00addiction remains unaf\u00adfected. <\/p>\n

\u00a7 6 Youth Pro\u00adtection<\/strong><\/p>\n

(1) When selling goods that are subject to the pro\u00advi\u00adsions of the Youth Pro\u00adtection Act, we only enter into con\u00adtractual rela\u00adti\u00adonships with cus\u00adtomers who have reached the legally required minimum age. Existing age rest\u00adric\u00adtions are indi\u00adcated in the respective product description. <\/p>\n

(2) By sub\u00admitting your order, you confirm that you have reached the legally required minimum age and that the infor\u00admation you have pro\u00advided regarding your name and address is correct. You are obliged to ensure that only you or persons aut\u00adho\u00adrized by you to receive the delivery, who have reached the legally required minimum age, take receipt of the goods. <\/p>\n

(3) Where we are required by law to carry out an age veri\u00adfi\u00adcation, we ins\u00adtruct the logi\u00adstics service pro\u00advider respon\u00adsible for delivery to hand over the goods only to persons who have reached the legally required minimum age and, in case of doubt, to request iden\u00adti\u00adfi\u00adcation from the person receiving the goods for age veri\u00adfi\u00adcation.<\/p>\n

(4) If, in the respective product description, we indicate that you must be at least 18 years old to purchase the goods, not\u00adwi\u00adth\u00adstanding the sta\u00adtutory minimum age, the above para\u00adgraphs (1)\u2013(3) shall apply with the proviso that legal majority is required instead of the sta\u00adtutory minimum age.<\/p>\n

\u00a7 7 Third-Party Service Pro\u00adviders<\/strong><\/p>\n

Service pro\u00adviders or service com\u00adpanies are com\u00adpanies in the ter\u00adtiary sector and have a form of ope\u00adration through which one or more ser\u00advices are pro\u00advided. Con\u00adtractual devia\u00adtions and changes between SpritzTour and the third-party service pro\u00advider must be agreed in writing in a con\u00adtract spe\u00adcific to the order. A sub\u00adse\u00adquent uni\u00adla\u00adteral amendment of the GTC con\u00adsti\u00adtutes an inad\u00admis\u00adsible con\u00adtractual change and is void. Con\u00adtractual changes as well as changes to the GTC can only be made with the written consent of Bier-Events. <\/p>\n

3.2.<\/strong> The com\u00adplete con\u00adtract text is not stored by us. Before sub\u00admitting the order via the online shopping cart system, the con\u00adtract data can be printed using the brow\u00adser\u2019s print function or saved elec\u00adtro\u00adni\u00adcally. After receipt of your order, the order data will be sent to you again by email. <\/p>\n

3.3.<\/strong> For quote requests made outside the online shopping cart system, you will receive all con\u00adtract data as part of a binding offer in text form, e.g. by email, which you can print out or save elec\u00adtro\u00adni\u00adcally.<\/p>\n
