I. General Terms and Con\u00addi\u00adtions<\/strong><\/p>\n

\u00a7 1 Basic Pro\u00advi\u00adsions<\/strong><\/p>\n

(1)<\/strong> <\/span>The fol\u00adlowing terms and con\u00addi\u00adtions apply to con\u00adtracts (ser\u00advices and products\/goods) that you con\u00adclude with us as the pro\u00advider (Bier-Events | Adam Hellmann) via the website www.spritztour.de. Unless otherwise agreed, any terms and con\u00addi\u00adtions you may use yourself are hereby rejected. <\/p>\n

(2)<\/strong> <\/span>A con\u00adsumer within the meaning of the fol\u00adlowing pro\u00advi\u00adsions is any natural person who enters into a legal tran\u00adsaction for pur\u00adposes that are pre\u00addo\u00admi\u00adnantly neither com\u00admercial nor self-employed pro\u00adfes\u00adsional in nature. An entre\u00adpreneur is any natural or legal person or a part\u00adnership with legal capacity that, when entering into a legal tran\u00adsaction, acts in the exercise of their inde\u00adpendent pro\u00adfes\u00adsional or com\u00admercial activity. <\/p>\n

\u00a7 2 For\u00admation of Con\u00adtract<\/strong><\/p>\n

(1)<\/strong> <\/span>The subject matter of the con\u00adtract is the sale of ser\u00advices and products\/goods.<\/p>\n

(2)<\/strong> <\/span>By listing the respective service\/product on our website, we are already making you a binding offer to con\u00adclude a con\u00adtract under the con\u00addi\u00adtions stated in the item description.<\/p>\n

(3)<\/strong> <\/span>The con\u00adtract is con\u00adcluded via the online shopping cart system as follows: The services\/goods intended for purchase are placed in the \u201cshopping cart\u201d. You can access the \u201cshopping cart\u201d at any time via the cor\u00adre\u00adsponding button in the navi\u00adgation bar and make changes there. After accessing the \u201ccheckout\u201d page and entering your per\u00adsonal data as well as the payment and shipping terms, all order data will be dis\u00adplayed once more on the order summary page. If you use an instant payment system (e.g. PayPal) as your payment method, you will be directed to the order summary page in our online shop or redi\u00adrected to the website of the instant payment system pro\u00advider to confirm the purchase there. You will then be redi\u00adrected back to the order summary page in our online shop.
By sub\u00admitting the order via the \u201corder with obli\u00adgation to pay\u201d button, you legally bin\u00addingly declare accep\u00adtance of the offer, thereby con\u00adcluding the con\u00adtract. <\/p>\n

(4)<\/strong> <\/span>The request for a quote is non-binding for you. We will submit a binding offer to you in text form (by email), which you can accept within the spe\u00adcified time. <\/p>\n

(5)<\/strong> <\/span>The pro\u00adcessing of the order and trans\u00admission of all infor\u00admation required in con\u00adnection with the con\u00adclusion of the con\u00adtract takes place by email, partly in an auto\u00admated manner. You must the\u00adr\u00adefore ensure that the email address you have pro\u00advided to us is correct, that receipt of emails is tech\u00adni\u00adcally ensured and in par\u00adti\u00adcular is not pre\u00advented by spam filters. <\/p>\n

(6)<\/strong> <\/span>Rebooking and Can\u00adcel\u00adlation:<\/p>\n

(6.1)<\/strong> <\/span>Rebooking of \u201cLive im Lokal\u201d tickets and live tastings to another pre\u00adferred date:

(6.4)<\/strong> <\/span>Terms regarding indi\u00advi\u00addually cus\u00adto\u00admized tastings:<\/p>\n

(6.4.1)<\/strong> <\/span>Changes to booking \/ adding indi\u00advidual persons as well as extras\/specials:
Changes to the booking are free of charge up to 14 days before the event
From 14 days before the event, and for each further change, a flat fee of \u20ac15 pro\u00adcessing charge applies
Can\u00adcel\u00adlation of indi\u00advidual persons is only pos\u00adsible up to 24 hours before the event
Rebooking the entire tasting to another pre\u00adferred date costs a flat fee of \u20ac50
Every change must be made in the form of an email<\/p>\n

(6.4.2)<\/strong> <\/span>Can\u00adcel\u00adlation of booking:
Must be made in the form of an email
Up to 4 weeks before the event, a can\u00adcel\u00adlation fee of \u20ac100 applies
From 4 weeks before the event, 50% of the total invoice amount applies as a can\u00adcel\u00adlation fee
From 48 hours before the event, 75% of the total invoice amount applies as a can\u00adcel\u00adlation fee<\/p>\n

(7)<\/strong> <\/span>Can\u00adcel\u00adla\u00adtions and changes on our part: It may occa\u00adsio\u00adnally happen that we need to correct some details, errors or changes. In the course of this, it may happen that we need to cancel or change already con\u00adfirmed tickets. We reserve the right to do so in such cases. <\/p>\n

\u00a7 3 Right of Retention, Retention of Title<\/strong><\/p>\n

(1)<\/strong> <\/span>You may only exercise a right of retention insofar as it con\u00adcerns claims arising from the same con\u00adtractual rela\u00adti\u00adonship.<\/p>\n

(2)<\/strong> <\/span>The goods remain our pro\u00adperty until full payment of the purchase price has been made.<\/p>\n

\u00a7 4 War\u00adranty and Gua\u00adrantees<\/strong><\/p>\n

(1)<\/strong> <\/span>The sta\u00adtutory rights of lia\u00adbility for defects apply.<\/p>\n

(2)<\/strong> <\/span>When purchasing used goods by con\u00adsumers: if the defect occurs after the expiry of one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods may be asserted within the sta\u00adtutory limi\u00adtation period of two years from delivery of the goods. For entre\u00adpre\u00adneurs, the limi\u00adtation period for claims for defects in newly manu\u00adfac\u00adtured items is one year from the transfer of risk. The sale of used goods is made excluding any war\u00adranty. The sta\u00adtutory limi\u00adtation periods for the right of recourse pur\u00adsuant to \u00a7 445a BGB remain unaf\u00adfected.
For entre\u00adpre\u00adneurs, only our own state\u00adments and the manu\u00adfac\u00adtu\u00adrer\u2019s product descrip\u00adtions incor\u00adpo\u00adrated into the con\u00adtract shall con\u00adstitute an agreement on the quality of the goods; we assume no lia\u00adbility for public state\u00adments by the manu\u00adfac\u00adturer or other adver\u00adtising claims. If the deli\u00advered item is defective, we shall provide war\u00adranty to entre\u00adpre\u00adneurs initially at our dis\u00adcretion by reme\u00addying the defect (sub\u00adse\u00adquent impro\u00advement) or by deli\u00advering a defect-free item (repla\u00adcement delivery).
The above rest\u00adric\u00adtions and shor\u00adtening of time limits do not apply to claims based on damages caused by us, our legal repre\u00adsen\u00adta\u00adtives or vica\u00adrious agents in cases of:
Injury to life, body or health
Inten\u00adtional or grossly negligent breach of duty as well as frau\u00addulent intent
Breach of essential con\u00adtractual obli\u00adga\u00adtions whose ful\u00adfilment makes the proper exe\u00adcution of the con\u00adtract pos\u00adsible in the first place and on whose com\u00adpliance the con\u00adtractual partner may regu\u00adlarly rely (car\u00addinal obli\u00adga\u00adtions)
Within the scope of a gua\u00adrantee promise, if agreed
Insofar as the scope of the Product Lia\u00adbility Act is opened
Infor\u00admation on any addi\u00adtional gua\u00adrantees that may apply and their exact con\u00addi\u00adtions can be found with the respective product and on special infor\u00admation pages in the online shop. <\/p>\n

(3)<\/strong> <\/span>As a con\u00adsumer, you are requested to inspect the goods upon delivery imme\u00addiately for com\u00adple\u00adteness, obvious defects and transport damage, and to notify us and the carrier of any com\u00adplaints as quickly as pos\u00adsible. Failure to do so will have no effect on your sta\u00adtutory war\u00adranty rights. <\/p>\n

\u00a7 5 Choice of Law, Place of Per\u00adfor\u00admance, Juris\u00addiction<\/strong><\/p>\n

(1)<\/strong> <\/span>German law applies. For con\u00adsumers, this choice of law only applies insofar as the pro\u00adtection granted by man\u00addatory pro\u00advi\u00adsions of the law of the state of the con\u00adsu\u00admer\u2019s habitual resi\u00addence is not with\u00addrawn thereby (prin\u00adciple of greater benefit). <\/p>\n

(2)<\/strong> <\/span>The place of per\u00adfor\u00admance for all ser\u00advices arising from business rela\u00adti\u00adonships with us, as well as the place of juris\u00addiction, is our regis\u00adtered office, pro\u00advided that you are not a con\u00adsumer but a mer\u00adchant, a legal entity under public law, or a special fund under public law. The same applies if you have no general place of juris\u00addiction in Germany or the EU, or if your domicile or habitual resi\u00addence is not known at the time the action is filed. The right to also call upon the court at another sta\u00adtutory place of juris\u00addiction remains unaf\u00adfected. <\/p>\n

\u00a7 6 Youth Pro\u00adtection<\/strong><\/p>\n

(1)<\/strong> <\/span>When selling goods subject to the regu\u00adla\u00adtions of the Youth Pro\u00adtection Act, we only enter into con\u00adtractual rela\u00adti\u00adonships with cus\u00adtomers who have reached the legally pre\u00adscribed minimum age. Existing age rest\u00adric\u00adtions are indi\u00adcated in the respective item description. <\/p>\n

(2)<\/strong> <\/span>By sub\u00admitting your order, you confirm that you have reached the legally pre\u00adscribed minimum age and that your details regarding your name and address are correct. You are obliged to ensure that only you yourself, or persons aut\u00adho\u00adrized by you to receive the delivery who have reached the legally pre\u00adscribed minimum age, accept the goods. <\/p>\n

(3)<\/strong> <\/span>Insofar as we are obliged by law to carry out an age veri\u00adfi\u00adcation, we ins\u00adtruct the logi\u00adstics service pro\u00advider com\u00admis\u00adsioned with the delivery to hand over the delivery only to persons who have reached the legally pre\u00adscribed minimum age, and if in doubt, to have the identity card of the person receiving the goods pre\u00adsented for age veri\u00adfi\u00adcation pur\u00adposes.<\/p>\n

(4)<\/strong> <\/span>Insofar as we indicate in the respective item description, beyond the legally pre\u00adscribed minimum age, that you must have com\u00adpleted your 18th year of life to purchase the goods, the above para\u00adgraphs 1\u20133 apply with the proviso that instead of the legally pre\u00adscribed minimum age, legal majority must be present.<\/p>\n

\u00a7 7 Third-Party Service Pro\u00adviders<\/strong><\/p>\n

Service pro\u00adviders or service com\u00adpanies are com\u00adpanies in the ter\u00adtiary sector and have a form of ope\u00adration through which one or more ser\u00advices are pro\u00advided. Con\u00adtractual devia\u00adtions and changes between SpritzTour and the third-party service pro\u00advider must be agreed in writing in a con\u00adtract spe\u00adcific to the order. A sub\u00adse\u00adquent uni\u00adla\u00adteral amendment of the GTC con\u00adsti\u00adtutes an inad\u00admis\u00adsible con\u00adtractual change and is void. Con\u00adtractual changes as well as changes to the GTC can only be made with the written consent of Bier-Events. <\/p>\n

3.2.<\/strong> <\/span>The com\u00adplete con\u00adtract text is not stored by us. Before sub\u00admitting the order via the online shopping cart system, the con\u00adtract data can be printed using the brow\u00adser\u2019s print function or saved elec\u00adtro\u00adni\u00adcally. After receipt of your order, the order data will be sent to you again by email. <\/p>\n

3.3.<\/strong> <\/span>For quote requests made outside the online shopping cart system, you will receive all con\u00adtract data as part of a binding offer in text form, e.g. by email, which you can print out or save elec\u00adtro\u00adni\u00adcally.<\/p>\n
